These Terms & Conditions ("Terms") govern your use of familytc.com (the "Website") and travel planning, booking, concierge, and related services provided by DMD Innovative Solutions Inc., doing business as Family Travel Concierge ("FTC").

By using our Website, submitting a travel inquiry, engaging FTC to provide travel planning or booking services, or otherwise using our services, you acknowledge and agree to these Terms.

Please read these Terms carefully before using our services.

1. About Family Travel Concierge

FTC is a travel planning and advisory business based in Connecticut.

FTC assists clients with planning and arranging travel, which may include:

  • Flights

  • Hotels and resorts

  • Cruises

  • Tours and excursions

  • Transportation and transfers

  • Car rentals

  • Travel insurance

  • Activities and experiences

  • Itineraries

  • Other travel-related services

FTC may also provide concierge services and assistance before, during, and after travel.

2. FTC's Role as a Travel Advisor

FTC acts as a travel advisor and intermediary between travelers and independent travel suppliers.

FTC does not own, operate, manage, or control the airlines, hotels, resorts, cruise lines, tour operators, transportation providers, car rental companies, travel insurance companies, activity providers, destination management companies, or other independent suppliers that provide travel services.

These suppliers are independent third parties and are responsible for providing their respective services.

When FTC arranges a reservation on your behalf, the applicable supplier's own terms, conditions, cancellation policies, refund policies, rules, and restrictions may also apply to your reservation.

By requesting or accepting a reservation, you agree to comply with the applicable supplier's terms and conditions.

3. Travel Planning and Service Fee

For FTC's World Exploration trips (excluding beach and cruise vacations), FTC charges a one-time $250 non-refundable service fee.

For group trips, FTC charges a one-time $500 non-refundable service fee. This fee does not apply in addition to the $250 World Exploration service fee described above. If a trip qualifies as a group trip, the $500 group trip service fee applies instead of the $250 World Exploration service fee.

These fees compensate FTC for professional travel planning and related services and are non-refundable once charged, including if the traveler subsequently decides not to proceed with the proposed trip, except where otherwise required by applicable law.

FTC may receive commissions or other compensation from certain travel suppliers and travel insurance providers in connection with bookings made through FTC.

The amount and availability of supplier compensation may vary by supplier, booking, and service.

4. Quotes, Prices and Availability

Travel prices and availability are subject to change until a reservation is confirmed by the applicable supplier.

A quote, proposal, itinerary, or price presented by FTC does not guarantee availability or price until the applicable reservation has been completed and confirmed.

Prices may be affected by factors including:

  • Supplier pricing changes

  • Availability

  • Taxes

  • Government fees

  • Resort or destination fees

  • Fuel surcharges

  • Currency exchange rates

  • Supplier-imposed charges

  • Changes requested by the traveler

  • Other circumstances outside FTC's control

FTC makes reasonable efforts to provide accurate pricing information. However, typographical, technical, supplier, system, or other pricing errors may occur.

FTC and applicable suppliers are not required to honor an obviously erroneous price where permitted by law.

5. Deposits and Payments

Travel reservations may require deposits, partial payments, or full payment according to the applicable supplier's requirements.

Payment deadlines vary by supplier and reservation.

Failure to make a required payment by the applicable deadline may result in cancellation of a reservation, loss of a deposit, increased pricing, or other consequences imposed by the supplier.

FTC is not responsible for a supplier's cancellation of a reservation resulting from a client's failure to make payment by the required deadline.

FTC does not store customers' complete credit or debit card numbers in its customer database.

Customers may receive payment links through third-party payment providers, including Square, or directly from tour operators, travel suppliers, or other providers.

Use of third-party payment systems is also subject to the applicable provider's terms and privacy practices.

6. Cancellations, Changes and Refunds

Cancellation, modification, and refund policies vary substantially among travel suppliers and reservations.

Your reservation is subject to the cancellation and change rules imposed by the applicable airline, hotel, cruise line, tour operator, insurance provider, transportation company, or other supplier.

Some reservations may be:

  • Fully refundable

  • Partially refundable

  • Refundable only before a specified deadline

  • Subject to cancellation or change penalties

  • Non-refundable

  • Non-changeable

FTC cannot override a supplier's cancellation, change, or refund policy.

Before authorizing a booking, travelers are responsible for reviewing and understanding the applicable cancellation and refund conditions.

The $250 World Exploration service fee and $500 group trip service fee described in Section 3 are non-refundable. Where the $500 group trip service fee applies, it replaces and does not apply in addition to the $250 World Exploration service fee.

Refunds owed by travel suppliers are subject to the supplier's processing procedures and timelines.

FTC does not guarantee the timing of a refund controlled or processed by a third-party supplier.

7. Traveler Responsibility to Review Reservations

Travelers are responsible for carefully reviewing reservation details and promptly notifying FTC of any errors or discrepancies.

This includes reviewing:

  • Traveler names and spelling

  • Dates of birth where applicable

  • Travel dates

  • Flight dates and times

  • Airports

  • Destinations

  • Hotels

  • Room categories

  • Cruise ships and cabins

  • Tours

  • Transportation

  • Passenger information

  • Other reservation details

Names used for airline tickets, cruises, and other travel reservations should match the traveler's applicable identification or travel documents as required by the supplier or government authority.

FTC should be notified promptly if information appears incorrect.

Costs resulting from corrections requested after a reservation has been confirmed may be subject to supplier fees, fare differences, or other charges.

8. Passports, Visas and Entry Requirements

Travelers are ultimately responsible for determining and satisfying all documentation and entry requirements applicable to their trip.

These may include:

  • Valid passports

  • Passport validity requirements

  • Visas

  • Electronic travel authorizations

  • Transit visas

  • Entry and exit requirements

  • Health documentation

  • Vaccination requirements

  • Customs requirements

  • Requirements relating to minors

  • Requirements based upon citizenship or passport nationality

  • Other governmental requirements

FTC may provide general information or assistance concerning travel requirements as a convenience to clients. However, government requirements can change, sometimes without advance notice.

Travelers are responsible for verifying current requirements with appropriate government authorities and ensuring that all members of their traveling party possess the documents necessary for travel.

FTC is not responsible for a traveler's inability to travel because of missing, expired, insufficient, incorrect, or otherwise unacceptable documentation, except to the extent liability cannot lawfully be excluded.

9. Travel Insurance

FTC may offer clients the opportunity to purchase travel insurance provided by independent third-party travel insurance companies.

FTC may receive commissions from travel insurance providers in connection with insurance policies purchased through FTC.

Insurance coverage, benefits, exclusions, limitations, claim requirements, eligibility requirements, and decisions concerning coverage are determined by the applicable insurance policy and insurance provider.

FTC does not make the final determination regarding whether an insurance claim is covered or payable.

Travelers are responsible for reviewing the insurance policy, including its coverage, exclusions, limitations, and deadlines, before purchasing coverage.

Purchasing travel insurance does not guarantee reimbursement for every cancellation, interruption, medical event, delay, weather event, or other loss.

10. Airline Reservations

FTC may assist clients with airline reservations.

Airline operations are controlled by the applicable airline and are subject to change.

Airlines may change:

  • Flight schedules

  • Flight numbers

  • Aircraft

  • Seat assignments

  • Routes

  • Connection times

  • Departure or arrival airports

  • Baggage policies

  • Fees

  • Other aspects of transportation

FTC cannot guarantee a particular aircraft, seat assignment, schedule, flight operation, or uninterrupted airline service.

Travelers should reconfirm relevant flight information and monitor communications from the airline and FTC before and during travel.

11. Travel Disruptions and Events Beyond FTC's Control

Travel is subject to circumstances that may be outside FTC's reasonable control.

These may include:

  • Severe weather

  • Hurricanes

  • Natural disasters

  • Flight cancellations or delays

  • Strikes

  • Labor disruptions

  • War

  • Terrorism

  • Civil unrest

  • Government actions

  • Border closures

  • Public health emergencies

  • Epidemics or pandemics

  • Transportation disruptions

  • Supplier operational changes

  • Supplier insolvency or bankruptcy

  • Hotel closures

  • Schedule changes

  • Acts of God

  • Other events beyond FTC's reasonable control

FTC may make reasonable efforts to assist clients affected by travel disruptions.

However, providing assistance does not mean that FTC caused, controls, guarantees resolution of, or assumes financial responsibility for the underlying event or the actions of independent suppliers.

Refunds, credits, rebooking, and other remedies resulting from such events may be governed by supplier policies, insurance coverage, and applicable law.

12. Independent Travel Suppliers

FTC selects and recommends suppliers based upon information reasonably available at the time of planning.

However, travel services are ultimately performed by independent suppliers.

FTC does not guarantee the acts, omissions, performance, financial condition, safety practices, personnel, facilities, equipment, or services of an independent supplier.

Descriptions, photographs, ratings, amenities, schedules, and other supplier information may be provided by the supplier or other third-party sources and may change.

FTC is not responsible for changes made by an independent supplier after a reservation has been made, although FTC may assist clients in addressing such changes.

13. Client Conduct

FTC reserves the right, subject to applicable law, to refuse, suspend, or terminate services where reasonably appropriate because of:

  • Fraud or attempted fraud

  • Nonpayment

  • Illegal activity

  • Threatening, abusive, harassing, or seriously inappropriate conduct toward FTC personnel

  • Intentional misuse of FTC's services

  • Material misrepresentation

  • Conduct that creates an unreasonable safety or security concern

  • Material violation of these Terms

Termination of FTC's services does not eliminate amounts already owed to FTC or independent suppliers and does not override applicable supplier cancellation policies.

14. Website Use

You agree not to use the Website to:

  • Violate applicable law

  • Engage in fraud

  • Impersonate another person

  • Submit knowingly false or misleading information

  • Introduce malware, viruses, or malicious code

  • Attempt unauthorized access to FTC systems or accounts

  • Interfere with Website operation or security

  • Circumvent security controls

  • Use automated systems to improperly scrape or extract Website content

  • Copy or commercially exploit FTC-created Website content without authorization

  • Otherwise misuse the Website or FTC's services

FTC may restrict access to the Website where reasonably necessary to protect the Website, FTC, its clients, or others.

15. Intellectual Property

Original materials created by FTC, including original Website text, branding, graphics, travel-planning materials, itineraries, written content, and other original materials, may be protected by copyright, trademark, and other intellectual property laws.

Except as permitted by law or with FTC's authorization, FTC-created materials may not be reproduced, republished, distributed, sold, or commercially exploited without permission.

FTC's use of third-party materials does not mean that FTC claims ownership of those materials.

Photographs, hotel descriptions, supplier logos, trademarks, destination information, and other content provided or owned by hotels, cruise lines, airlines, tour operators, tourism organizations, photographers, technology providers, or other third parties remain subject to the rights of their respective owners.

Nothing in these Terms transfers ownership of third-party intellectual property to FTC.

16. Client Photos, Reviews and Testimonials

FTC may feature client reviews, testimonials, or photographs in connection with its Website, social media, or marketing.

FTC obtains permission before using a client's personal photographs for FTC marketing or promotional purposes.

Reviews published voluntarily through third-party review platforms may also be displayed or referenced in accordance with applicable platform rules and law.

FTC will not claim ownership of a client's personal photographs merely because permission has been granted to use them.

17. Website Information

FTC makes reasonable efforts to keep Website information accurate and current.

However, travel information changes frequently.

Destinations, hotels, amenities, attractions, supplier policies, schedules, prices, entry requirements, and other information may change after Website content is published.

Website content is therefore provided for general informational purposes and should not be interpreted as a guarantee that particular travel services, prices, amenities, or conditions will remain available.

SMS/Text Messaging Terms

18. SMS/Text Messaging

FTC may communicate with customers and prospective customers by SMS/text message when appropriate consent or permission has been provided.

SMS communications may relate to:

  • Travel inquiries

  • Travel planning

  • Quotes

  • Reservations

  • Booking information

  • Appointment or call coordination

  • Payment-related reminders

  • Itinerary information

  • Trip updates

  • Flight or other travel disruptions

  • Reservation changes

  • Customer service

  • Travel assistance

  • Emergency travel assistance

  • Follow-up concerning requested travel services

Message frequency varies. Message and data rates may apply.

FTC's SMS program is used for communications relating to travel inquiries, travel planning, reservations, trips, customer service, and other services requested by the customer.

Consent provided through the Plan My Trip form does not constitute consent to receive unrelated promotional or mass-marketing text messages.

19. SMS Consent

FTC may obtain SMS consent through an affirmative Website opt-in, written consent, documented verbal consent, or other methods permitted by applicable law and applicable messaging requirements.

A customer may provide consent by:

  • Affirmatively selecting an SMS consent checkbox on an FTC Website form

  • Providing written consent

  • Providing documented verbal consent

  • Otherwise expressly requesting SMS communications through a method permitted by applicable law and messaging requirements

Where an SMS checkbox is presented on the Website, it is optional and is not pre-selected.

Consent to receive SMS messages is not a condition of purchasing travel services.

If a customer initiates a text conversation with FTC, that communication constitutes consent for FTC to respond within the context of that conversation. Initiating a text conversation does not constitute consent to receive unrelated SMS communications or unrelated promotional or mass-marketing text messages.

20. SMS Opt-Out

You may withdraw consent to receive SMS messages at any time.

Reply STOP to an FTC SMS message to opt out of further applicable SMS communications.

FTC's messaging system processes applicable SMS opt-out requests, and FTC will honor opt-out requests in accordance with applicable law and messaging requirements.

Other communications that reasonably indicate that you want FTC to stop sending text messages will also be handled as opt-out requests where required by applicable law.

22. SMS Delivery

SMS delivery depends upon wireless carriers, networks, devices, and other systems outside FTC's control.

FTC does not guarantee that every SMS message will be delivered or received at a particular time.

To the extent permitted by applicable law, FTC is not responsible for delayed or undelivered messages caused by wireless carriers, telecommunications providers, network failures, device settings, or other circumstances outside FTC's reasonable control.

23. SMS Privacy

FTC does not sell or rent customers' mobile telephone numbers or SMS consent information to third parties for their independent marketing or promotional purposes.

FTC does not share SMS consent information with third parties for those third parties' independent marketing or promotional purposes.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

A customer's telephone number may nevertheless be provided to a hotel, airline, cruise line, transfer provider, driver, tour operator, or other travel supplier when reasonably necessary to provide travel services specifically requested by that customer.

Such operational sharing does not transfer the customer's consent to receive FTC text messages to the travel supplier for the supplier's independent marketing purposes.

24. Privacy

FTC's collection, use, disclosure, and protection of personal information is described in the Family Travel Concierge Privacy Policy.

The Privacy Policy forms an important part of our Website privacy and communications practices and should be reviewed together with these Terms.

25. Third-Party Websites and Payment Services

During the planning and booking process, FTC may provide customers with links by email, SMS, or other direct communication to payment processors, travel suppliers, tour operators, insurers, or other third-party services.

For example, FTC may provide a Square payment link or a payment link operated by a travel supplier.

FTC does not control the privacy, security, Website operation, or contractual terms of independent third-party services.

Your interaction with those services may be subject to separate terms and privacy policies.

26. Limitation of Liability

To the fullest extent permitted by applicable law, FTC is not responsible for loss, damage, delay, inconvenience, injury, additional expense, or other consequences resulting from the acts, omissions, failures, or insolvency of independent travel suppliers or from circumstances outside FTC's reasonable control.

FTC does not exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

To the fullest extent permitted by applicable law, FTC will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of the Website or FTC's services.

Nothing in these Terms is intended to eliminate rights or remedies that cannot legally be waived or limited.

27. No Guarantee of Travel Outcome

FTC uses professional judgment and information reasonably available when making travel recommendations.

Travel experiences are inherently subjective and can be affected by factors beyond FTC's control.

A recommendation of a hotel, resort, cruise, tour, restaurant, destination, activity, or other supplier does not guarantee that every traveler will have the same experience or level of satisfaction.

28. Minimum Age

Individuals directly engaging FTC to arrange travel or submitting booking requests must generally be at least 18 years old.

Travel may be arranged for children and minors by their parents, guardians, or other adults authorized to arrange their travel.

29. Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles, except where applicable federal law or other law requires otherwise.

30. Disputes

FTC encourages customers to contact us first regarding concerns so that we have an opportunity to attempt to resolve the matter.

Nothing in these Terms requires binding arbitration unless FTC and the applicable customer separately agree to arbitration in writing.

Any legal dispute that is not otherwise resolved will be handled in accordance with applicable law and applicable rules concerning jurisdiction and venue.

Nothing in these Terms is intended to deprive a consumer of a legal right concerning jurisdiction or venue that cannot lawfully be waived.

31. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

The invalid or unenforceable provision will be interpreted or limited to the minimum extent necessary to make it enforceable where permitted.

32. No Waiver

FTC's failure to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or FTC's right to enforce it in the future.

33. Changes to These Terms

FTC may update these Terms periodically to reflect changes in:

  • Our services

  • Business practices

  • Website

  • Technology

  • Supplier relationships

  • Communications practices

  • Applicable laws or regulations

When these Terms are updated, the Last Updated date at the top of this page will be revised.

Your continued use of the Website and FTC services after updated Terms become effective is subject to applicable law.

34. Relationship With Supplier Terms

These Terms govern the relationship between the customer and FTC.

Individual travel reservations may also be subject to separate terms imposed by airlines, hotels, cruise lines, tour operators, insurers, transportation providers, and other suppliers.

If a supplier's terms apply to a particular reservation, those supplier terms govern the travel service provided by that supplier.

These Terms do not modify or override the contractual obligations of an independent supplier.

35. Entire Website Terms

These Terms, together with the Family Travel Concierge Privacy Policy and any additional written terms expressly applicable to a particular FTC service, constitute the terms governing use of the Website and FTC's services to the extent applicable.

A specific written agreement applicable to a particular transaction may supplement these Terms.
